Employer Negligence Can Mean Life or Death

One of the fundamental rights of all workers is safety in the workplace. Employers are responsible for guaranteeing a safe environment for workers where they can perform their duties without affecting their physical or mental health.

In the following note, we will see how employers’ negligence can put the health and well-being of their employees at risk, leading to devastating consequences.

First, we must clarify what we mean by “employer negligence.” This refers to the need for concrete, correct actions by the employer to guarantee a safe environment, which includes not providing safety equipment, training, facilities in poor condition, and failure to comply with current regulations regarding safety and prevention measures.

There are two types of negligence. The “active” one occurs when decisions are made that put workers at risk, and the “passive” one occurs when the necessary measures are not taken to prevent accidents and injuries.

Some of the clearest examples of this are:

  1. Lack of Training: employees must be trained to handle machinery, dangerous substances, or emergency procedures.
  2. Working Conditions: Facilities should be clean, tidy, and free of danger. Equipment repairs and proper compliance with protocols are also important.
  3. Lack of Personal Protective Equipment (PPE): In many jobs, employers must wear helmets, gloves, glasses, etc., and the employer must provide these items to avoid all types of injuries.
  4. Non-compliance with Safety Standards: specially designed for different work environments depending on their functions and possible risks.

The consequences of this type of negligence can cause different injuries ranging from the mildest to very serious and even with long-term consequences and lifelong disability.
